Four Pillars, One Ledger: Relationship Evidence When One of You Owns a Business

Take a couple we will call Wei and Georgia. Wei is the sole director of a plumbing company. Georgia is the Australian sponsor. They have no joint bank account, because Wei's accountant told him to keep business and personal money apart. On the surface, the financial part of their file looks empty. In the company's records, it is the strongest part of the application.

In short: the Migration Regulations require the Department to consider the financial, household, social and commitment aspects of your relationship. Company records, loan security and shareholdings can carry as much weight as a joint account in an $11,710 application, provided they agree with the forms.

Where the four aspects come from

The Regulations require the Department to consider all the circumstances of the relationship, and they name four aspects. The financial aspects, the nature of the household, the social aspects, and the nature of the commitment to each other. The same framework applies to married and de facto couples. The weight given to each depends on your circumstances, so no two files look the same.

The ledger: financial evidence from a business

Wei's company records tell the officer more than a joint account would. The director loan account shows regular household draws. The company pays the rent on the shared home, and the accounts and the tax treatment say so. Georgia is a guarantor on the business overdraft. The family trust names her as a beneficiary. Both have nominated each other as superannuation beneficiaries.

Every one of those is a commercial decision before it is visa evidence. A shareholding moved to a partner changes control. Signing as guarantor creates a personal liability. A trust deed has tax consequences. We do not let a client sign any of them for the visa alone. Our commercial practice reviews the shareholder agreement, the loan documents and the deed, and the migration team then places them in the file.

Building the file over time

Evidence should span the whole relationship, not the months before lodgement. A continuous timeline persuades. A burst of recent documents does not.

How the file is read

The officer is not counting documents. The officer is testing whether one story runs through all four aspects. Company records are useful precisely because they can be checked. That cuts both ways. Never pad the file with inaccurate material. False or misleading information can engage PIC 4020, with consequences that outlast the application.

We keep our finances separate for asset protection. Does that hurt us?

Not on its own. Many genuine couples keep money apart, and business owners often do so on professional advice. What matters is that you explain the arrangement and show sharing in other ways. The commercial reason for the structure is itself evidence of a shared plan, provided the accountant's advice and your statements describe it the same way.

Organising the evidence

One section per aspect. A short timeline of the relationship at the front, as a map. Every document labelled with names and a date. Aim for a handful of strong documents per aspect per year, each carrying both names, a date and an address where possible. Quality, coverage and consistency win partner visa files. Volume does not. Frequently asked questions

Are company shares held by my partner good financial evidence?

Yes, because the shareholding is recorded on an independent register with a date. It shows a pooled financial interest. It is also a commercial decision with control and tax consequences, so take advice before transferring shares.

My partner is a director of my company. Does that count?

It supports the financial and commitment aspects, provided the appointment is real and recorded with ASIC. Make sure the appointment date and the address on the register match what the application says.

Can a trust distribution to my partner be evidence?

It can, if the trust deed names your partner as a beneficiary and the distribution appears in the accounts. It shows financial interdependence. Keep the deed, the resolution and the tax return consistent with your statements.

How do we show commitment after a year apart?

Messages and calls across the separation, visits, joint bookings and the plan that ended the separation. Explain the reason for the time apart in both statements, using the same dates.

Does the company's address need to match our home address?

No. Many businesses are registered elsewhere. What matters is that every address in the file is explained the same way, so the officer never has to ask why two documents differ.
